When purchasing a license you must agree to the following terms and conditions:
License
A+ Scientific, LLC gives you the right to use one copy of the enclosed ChemDBsoft software(“Software”) on a single computer. This license also authorizes you to create an extra copy of the software for backup purposes.
You may not rent or lease the Software, but you may transfer the Software and the accompanying materials on a permanent basis provided that you retain no copies and the recipient agrees to the terms of this Agreement.
Warranty
A+ Scientific, LLC, warrants the disk on which the software was furnished to be free from defects in materials and workmanship, under normal use, for a period of ninety (90) days after the date of purchase. If, during this period, a defect should occur, the disk will be replaced without charge.
A+ Scientific, LLC warrants that the software will perform substantially in accordance with the accompanying written materials and authorized advertising. A+ Scientific, LLC does not warrant that the functions contained in this software will meet your requirements or that the operation of the Software will be uninterrupted or error-free.
THE EXPRESSED WARRANTIES SET FORTH IN THIS AGREEMENT ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
A+ Scientific, LLC shall not be responsible for, and shall not pay, any amount of incidental, consequential or other indirect damages, whether based on lost revenue or otherwise, regardless of whether A+ Scientific, LLC was advised of the possibility of such losses in advance. In no event shall A+ Scientific, LLC's liability hereunder exceed the amount of license fees paid by Licensee, regardless of whether Licensee's claim is based on contract, tort, strict liability, product liability or otherwise.
Governing Law
This Agreement shall be construed and enforced in accordance with the laws of the state of Delaware
